Terms of Service

1. Acceptance of Terms

By accessing or using the SUGAR website and services located at sugardating.io (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service. SUGAR reserves the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. SUGAR reserves the right to request proof of age at any time and to terminate your access if you do not meet this requirement.

3. Waitlist and Account Registration

By joining the SUGAR waitlist, you submit personal information including but not limited to your name, email address, phone number, Instagram handle, and estimated net worth. You agree that all information provided is accurate and current. SUGAR reserves the right to accept or deny any waitlist application at its sole discretion.

Submission of a waitlist application does not guarantee access to the Service. SUGAR operates on an application-review basis, and acceptance is determined by internal criteria that may include but are not limited to profile completeness, verification status, and community fit.

4. User Conduct

You agree not to:

  • Provide false, misleading, or inaccurate information during registration or at any time
  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Harass, abuse, or harm another person through the Service
  • Attempt to gain unauthorized access to the Service, other user accounts, or computer systems
  • Use automated means, including bots, scrapers, or similar technology, to access the Service

5. Intellectual Property

The Service and its original content, features, and functionality are owned by SUGAR and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The SUGAR name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SUGAR. You may not use such marks without prior written permission.

6. Communications and TCPA Consent

By providing your phone number and consenting to receive communications, you agree to receive recurring automated promotional and personalized marketing text messages from SUGAR. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP. For help, reply HELP.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SUGAR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SUGAR DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO MATCHES, CONNECTIONS, OR RELATIONSHIPS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUGAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL SUGAR'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless SUGAR, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

11. Termination

SUGAR may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
